1. PURPOSE

YoureFAN provides, through the Site, a sponsorship service consisting of printing the Client’s photograph on the jersey (hereinafter the “Jersey”) of one or more players of one or more teams from various sports, or on any other medium related to such players and teams (hereinafter the “Service”). The list of available sports, teams, and players is displayed on the Site.

2. CONTRACT

2.1 Client Account
In order to enter into a contract with YoureFAN, the Client must create a customer access account. The Client undertakes to provide accurate, complete, and up-to-date personal data, and to update such data whenever changes occur.

YoureFAN reserves the right to close, without prior notice, any account containing false, incomplete, or outdated information, or which otherwise breaches these Terms.

The Client must select a username and password to access the Site. The Client agrees not to share their password with any third party and to keep it confidential. YoureFAN declines all liability for improper use of the Site and/or the Service arising from insufficient protection of the password by the Client. The Client is solely responsible for their account and any orders placed through it, except in cases of fraud or gross negligence by YoureFAN.

The Client must also provide a photograph of themselves meeting the criteria defined on the Site. This photograph will be used to perform the ordered Service. By confirming their order as described in section 2.3 below, the Client authorizes YoureFAN to use the photograph for the execution of the Service and for marketing purposes, including publication on the YoureFAN website and in promotional materials. If jerseys of the selected team are not fully filled with photographs, YoureFAN may use the Client’s photograph to complete such jerseys, without additional cost to the Client.

The Client warrants to YoureFAN that they hold all necessary rights in and to the photograph and that such use does not infringe upon the rights, including image rights, of any third party. Should a third party bring a claim against YoureFAN alleging infringement of rights due to the photograph provided, the Client agrees to indemnify YoureFAN against all damages and costs incurred. YoureFAN shall not be held liable for the Client’s unauthorized use of an image.

2.2 Product Selection
To order a product through the Site, the Client must log in to their account with their username and password, then select the desired product. Details and purchase conditions will be specified on the Site. Only products marked as available may be ordered, subject to stock availability. If the selected product becomes unavailable, YoureFAN shall promptly notify the Client.

2.3 Order Confirmation
A summary of the order will be displayed to the Client. By confirming the order, the Client acknowledges verifying its accuracy and accepts these Terms.

All orders are final and cannot be cancelled or modified by the Client after confirmation, including the information provided (such as the photograph).

The order will be confirmed by email once full payment has been received by YoureFAN.
The contract is deemed concluded once YoureFAN has received payment in full and sent confirmation of the order to the Client.

3. PERFORMANCE OF THE CONTRACT

3.1 Timeframe
Execution times for the Service are provided for information only. YoureFAN shall not be held liable for any failure to meet such deadlines.

3.2 Transfer of Risk
For products requiring shipment, YoureFAN’s obligations are fulfilled upon delivery of the product to the carrier. Shipment is at the Client’s risk. For Services, YoureFAN’s obligations are fulfilled once the order data, including the photograph, has been transferred to the third party responsible for printing the Jersey or otherwise finalizing the Service.

3.3 Prices
Unless otherwise specified, all prices displayed on the Site include applicable taxes (TPS and TVQ in Québec). Prices are expressed in Swiss francs (CHF), euros (EUR), Canadian dollars (CAD), and U.S. dollars (USD). Other currencies displayed are for reference only. Final sales may be made in CHF, EUR, CAD, or USD.

Prices are binding only upon order confirmation and may change at any time before that point. For shipments outside Switzerland, all taxes, customs duties, and related charges shall be borne by the Client.

3.4 Payment
Full payment of the order amount, as indicated in the order summary, must be made by credit card. Orders are confirmed only after receipt of full payment.

4. TERMINATION OF THE CONTRACT
Once confirmed, Client orders are final and cannot be cancelled or modified, including the photograph provided.

YoureFAN reserves the right to cancel orders. If cancellation results from the Client’s misconduct under these Terms—such as providing unlawful, immoral, or inappropriate content—the Client shall not be entitled to any refund. If performance of the Service becomes impossible without fault of YoureFAN, the Client shall be refunded the purchase price minus any expenses incurred by YoureFAN.

4.1 Termination of Service
YoureFAN may, at its sole discretion and without prior notice, suspend or terminate the Service for one or all users. YoureFAN may terminate Client access to the Service without cause or notice, which may result in the deletion of all information associated with the Client’s account. The Client may terminate their account by following the instructions provided on the Site. All provisions of these Terms which by their nature should survive termination shall so survive, including but not limited to ownership provisions, warranty disclaimers, indemnities, and limitations of liability.

4.2 Intellectual Property Rights
On the Site: All intellectual property rights relating to the Site remain the sole property of YoureFAN.

On Client-provided images: The Client warrants that they hold all necessary rights to any images or other content they provide and that such content does not infringe intellectual property rights of third parties. YoureFAN shall not be liable for any such infringements; the Client bears sole responsibility.

If a third party brings a claim against YoureFAN based on infringement caused by Client-provided images or content, the Client shall indemnify YoureFAN for all damages, including legal fees.

On the trademark: The YoureFAN trademark is a registered trademark. Only YoureFAN and its licensees may use it. The Client may not use the trademark for any purpose without the prior written consent of YoureFAN. Nothing in these Terms shall be construed as granting any implicit license to use the YoureFAN trademark.

4.3 Warranties
Regarding athletes and teams: As players may transfer between teams or retire, YoureFAN cannot guarantee that a player selected by the Client will remain with the same club or continue to play. In such cases, YoureFAN may, at its discretion, allow the Client to amend the order by choosing to (i) retain the same player with their new club, (ii) select another player from the original club, or (iii) select a new player from another club, subject to availability.

If the Client fails to provide a choice within the period specified by YoureFAN, YoureFAN may select the player and team at its discretion or decline to perform the contract. In the latter case, no refund will be issued.

Regarding Site and Service availability: YoureFAN does not guarantee uninterrupted or error-free access to the Site or Service. No warranty is provided as to availability, functionality, or error correction, and YoureFAN shall not be liable for direct or indirect damages resulting from interruptions.

Maintenance or updates may cause interruptions. While YoureFAN will endeavor to notify Clients in advance of planned interruptions, no guarantee is made.

Internet access required to use the Site and Service is the sole responsibility of the Client.

4.4 Limitation of Liability
1. YoureFAN shall not be liable for direct damages unless caused by fraud or gross negligence.

2. To the fullest extent permitted by law, YoureFAN shall not be liable for indirect or consequential damages, including but not limited to loss of revenue, profits, business opportunities, contracts, goodwill, anticipated savings, or data, whether foreseeable or not.

3. The Site and Services are provided “as is” and “as available” without warranty of any kind.

4. YoureFAN does not warrant that the Service will be uninterrupted, timely, secure, or error-free.

5. YoureFAN does not warrant that products, services, or information obtained will meet the Client’s expectations.

4.5 Personal Data
YoureFAN respects the privacy of its Clients. The Privacy Policy is available on the Site. Personal data collected in connection with this Contract—whether during account creation, order placement, or otherwise—shall be used solely for the purposes for which it was collected. By using the Service, the Client consents to the transfer and processing of their personal data in Canada.
